The learned counsel for appellant has filed pursis stamp no.13214/2018 dated 24.09.2018 praying for withdrawal of instant appeal contending that as per the directions issued by the Central Board of Indirect Taxes and Customs, New Delhi, vide Instruction F. No.390/Misc/116/2017-JC dated 11.7.2018, no appeal is to be preferred when the subject matter is below Rs.50 Lacs. Subject matter in the appeal is to the extent of Rs.09,34,000/-. In the circumstances, the appeal is allowed to be withdrawn with direction to refund the court fees to the appellant. JUDGE JUDGE Gulande
