Yesterday the matter was heard at length wherein we expressed our non-inclination to grant the relief as prayed for. At that time, the learned Counsel appearing for applicants requested to keep the matter today only for seeking instructions as to whether the matter can be withdrawn.

In the aforesaid background, the Rgd.

Order 0202apl419.22 learned Counsel for applicants today seeks permission for withdrawal of the application. Criminal Application is accordingly disposed of as withdrawn. Needless to mention that all the points raised in the application, are kept open to be considered at appropriate stage.

Since the matter has been argued by the Advocate Darunde, holding for the appointed Advocate, we direct the Secretary, High Court Legal Services Sub Committee, Nagpur to disburse the fees of the appointed counsel to Advocate Darunde, deeming that he has been appointed in the matter.
