Heard Shri P.K. Sathianathan, advocate for the applicant and Shri T.A. Mirza, A.P.P. for the non-applicant. While directing release on bail by the oder dated 16th February, 2016 this Court directed that out of two solvent sureties to be furnished by the applicant, one solvent surety shall be furnished by the father of the applicant. Shri Vinod Ramlal Turkel - father of the applicant has sworn the affidavit in support of this application stating that he is not owning any immovable property and therefore, he is not able to furnish solvent surety as directed by this Court. It is submitted that Shri Arvind Kanhaiyalal Dakah, resident of Gaddigudam, Gautam Nagar, Nagpur-maternal uncle of the applicant is ready to furnish the solvent surety. Though the application is opposed by Shri T.A. Mirza, learned A.P.P., accepting the statement made by Shri Vinod Ramlal Turkel on oath, the condition imposed by the order dated 16th February, 2016 is modified as under :

2 appp227.16 It is directed that the applicant shall be released on bail on furnishing P.R. Bond in the sum of Rs.Twenty Five Thousand and two solvent sureties in the like amount, out of which one solvent surety shall be by Shri Arvind Kanhaiyalal Dakah, resident of Gaddigudam, Gautam Nagar, Nagpur, as stated in paragraph 3 of the application.

The criminal application is allowed in the above terms.
