The applicant is arrested on 11th August, 2016 in connection with crime registered against her, initially for the offence punishable under Sections 307 and 450 of the Indian Penal Code, however, subsequently converted into one under Section 302 of the Indian Penal Code. The crime is registered against the applicant on F.I.R. lodged on 10th August, 2016 that because of some dispute regarding payment of amount, the applicant poured kerosene on the person of deceased and set her ablaze, that the deceased suffered 80% burn injuries and after a period of 4 days of the incident, she succumbed to the injuries.
The facts on record show that the investigating agency is relying on the dying declaration of victim and the statements of eye witnesses.
2 ba192.17 Though the applicant is a woman, aged about 31 years, and it is her case that she has to look after three minor children, considering the facts of the case, I am not inclined to grant the prayer made in the application. It is dismissed. However, Sessions Court is requested to expedite the trial.
