Heard learned Counsel for the appellant and respondent.

Perused Pursis St. No.9511 of 2018 by which appeal is prayed to be withdrawn. According to the instructions received by the appellant/department vide F.No.390/Misc/116/2007-JC, dt.11.07.2018, no appeal is stated to be filed when the subject matter is below Rs.50 Lacs. The amount involved in the present appeal is to the extent of Rs.38,65,000/-, which as such is below the monetary limits. In view of the pursis and facts as aforesaid, the appeal is allowed to be withdrawn.

The appellant would be entitled to Court fees as per rules.
