This is an application filed by the learned counsel for the applicant/ appellant seeking permission to withdraw the appeal on the ground that the matter is settled between the parties during the process of Mediation. The terms of settlement have been annexed with the application.

The learned counsel for the applicant/ appellant further submitted that the parties have filed a petition for divorce by mutual consent under Section 13(b) of the Hindu Marriage Act, 1955, and accordingly, the decree has been passed by the Family Court, Nagpur.

In this view of the matter, the Civil Application is allowed. The Family Court Appeal No. 36/2015 stands disposed of as withdrawn.
