Learned counsel for the petitioner submits that as the third party interest is created during the pendency of the present matter, the purpose of filing of the present writ petition is frustrated and therefore, he wants to withdraw the present writ petition.

He further seeks liberty to move a fresh application if the trial Court permits to add the subsequent purchaser as a party to the suit.

Permission is granted with liberty as prayed for.

Writ petition is disposed of.
