DATED : 26-03-2020 This Court heard the learned Counsel Shri S.V. Sirpurkar for the applicant at length on the last date of hearing. The hearing was adjourned to enable the learned Additional Public Prosecutor to make a statement on the status of the investigation. Today, the learned Additional Public Prosecutor Shri P.S. Tembhare fairly states that the investigation is almost complete and the charge-sheet is likely to be filed within the next seven to eight days.

The applicant is a student and is in custody since 29-1-2020 in connection with Crime 49/2020 registered with the Chandur Bazar Police Station, District Amravati for offence punishable under Section 306 of the Indian Penal Code.

This Court has perused the case diary and in particular the suicide note, which according to the prosecution, is penned by the deceased. While it would

2 ba162.20 not be appropriate to make any decisive observation on the submission of the learned Counsel Shri S.V. Sirpurkar that there is no material to suggest that the applicant intended to drive the deceased to take the extreme step and that the deceased could not bear the normal wear and tear of a relationship, considering the nature of the accusations, the fact that the investigation is complete, that the applicant is a student and further incarceration may not be necessary inasmuch as releasing the applicant from custody is not likely to hamper the course of investigation or the subsequent trial, I am inclined to allow this application.

The applicant be released on furnishing personal bond of Rs.20,000/- with a solvent surety of like amount. 5.

The applicant shall not enter the territorial limits of Chandur Bazar Police Station till the conclusion of the trial, unless specifically permitted to do so by the jurisdictional Court.

6.

The applicant shall not, directly or indirectly, make any attempt to influence the witnesses or the course of trial.
