Issue notice to the non-applicant.

Learned Additional Public Prosecutor waives notice on behalf of the non-applicant. This application is filed for suspension of sentence and for bail.

Learned counsel for the applicant submits that applicant is convicted for the offence punishable under Section 354 of the Indian Penal Code and is sentenced to suffer rigorous imprisonment for one year .....2/-

and and to pay a fine of Rs.25,000/-, in default, to suffer rigorous imprisonment of one month.

It is contended that applicant was on bail pending Trial and on his conviction his sentence is suspended for a period of one month which period has expired yesterday. Applicant has also made payment of fine amount.

Considering the fact that applicant was on bail pending Trial and since his sentence is suspended by the Trial Court, the application is allowed as per order below.

Sentence imposed upon applicant is suspended.

Applicant shall be released on bail on his executing P.R. Bond in the sum of Rs.15,000/- with one surety in the like amount.

While on bail, applicant shall mark his presence with Gondpipari Police Station, Taluka Gondpipari, District Chandrapur quarterly on the first day of each such month, pending Trial.

Application stands disposed of as such.
