DATE : 03/05/2023 1] Since the controversy regarding the existence of the approach road to the land of Gat No. 35, is not clear either from the spot inspection report as well as the impugned order, the impugned order passed by the learned Additional Collector is set aside and the matter is remanded back to the learned Additional Collector, who will conduct a spot inspection personally in the presence of the parties and verify for himself the existence of a road and thereafter pass the appropriate order.

2] The petition is allowed in above terms.

No costs.

3] The parties shall appear before the learned Additional Collector on 8.5.2023.
