The learned counsel for the applicant has pointed out an error in recording the date of cross-examination as 12.08.2015 in para 5 of the order dated 03.01.2023 and further considering the said, observing that there was delay in filing application Exh.46. It is pointed out that, the order dated 12.08.2015 is in relation to the proceeding under Domestic Violence Act and not under the Hindu Marriage Act.

Hence, I am of the view that the matter needs to be heard afresh.

Accordingly, the order dated 03.01.2023 is recalled.

The office is directed to place the writ petition for re-hearing on 05.09.2023 at 02:30 p.m.

The application is disposed of.
