This petition takes exception to the order dated 11.08.2023 passed by the Industrial Court, Nagpur, in Revision Application (ULP) No.48/2023. 2.

By the order impugned, the learned Industrial Court has allowed the Revision Application filed by the respondent against the order of the learned Labour Court dated 03.04.2023, by which the complaint filed by the petitioner was restored and the delay in filing the application for restoration was condoned.

I have heard Mr. Deshpande, learned counsel for the petitioner and Ms. Singh, learned counsel for respondent Nos.1 and 2.

The petitioner has filed an affidavit that he will not claim the back wages from 09.05.2013 to till date. In that view of the matter, I am inclined to grant one opportunity to the petitioner.

The writ petition is allowed. The order impugned is set aside.
