DATE : 5.5.2016 Heard Shri A.S. Mardikar learned Senior Advocate assisted by Shri S.G. Joshi, Advocate for the applicant and Shri A.D. Sonak, learned A.P.P. for the non-applicant.

The applicant is arrested on 20th March, 2015 in crime registered against six persons (including the applicant) for the offences punishable under Sections 364, 302, 201, 120-B and 34 of the Indian Penal Code.

According to the prosecution, the applicant is involved in the offence of murder of his son. The other son of the applicant is also co-accused. According to the prosecution, deceased was demanding his share in the property and because of the dispute regarding the property the deceased is murdered. The other five accused are released on bail. The

2 ba126.16 charge-sheet is filed. The investigation is complete. Considering the facts on the record and as the non-applicant has not been able to show that the custody of applicant is required for further investigation, in my view, the applicant is entitled to be released on bail.

Hence, the following order:

(i) The applicant having been arrested in Crime No.28/2015 registered by the non-applicant, he be released on bail on furnishing P.R. bond for Rs.25,000/- (Rs. Twenty Five Thousand Only) and two solvent sureties in the like amount. (ii) The applicant shall regularly attend the sessions trial on every date, unless exemption is granted by the Sessions Court. (iii) The application is allowed accordingly.
