Learned Advocate for the petitioner is making statement that respondent Nos.3 to 6 are not necessary parties. He seeks permission to delete their names. Said amendment be carried out forthwith.

Heard both sides and perused the reply on behalf of respondent No.2.

Taking into consideration affidavit-in-reply specially para 9 it appears that the Investigating Officer has substantially investigated the matter and reached to the conclusion prima facie that the accused persons have committed fraud thereby prepared false and bogus documents without right and authority by hatching up criminal conspiracy and also cheated the informant. If the Investigating Officer is satisfied with the documents which he has collected, then there should not be a hurdle to file chargesheet. He may file said chargesheet within a period of two weeks before the competent Court. Investigating Officer also says that he is yet to receive a report from Wakf Board and certain documents which he can collect under Section

2 wp205.2023 173(8) of the Code of Criminal Procedure. In view of this progress, it appears that purpose of the petition is satisfied and, therefore, in view of those observations, the writ petition stands disposed of.
