This is an application under Section 482 of the Code of Criminal Procedure challenging First Information Report No.39/2020 registered with Wadi Police Station, Nagpur for offences punishable under Sections 143, 147, 148, 149, 325, 307, 323, 504, and 506 of the Indian Penal Code. The application is filed on 24.2.2020. 2.

Today, when this application is listed for its admission, learned counsel Shri Ayush Sharma for the applicant submits that applicant-Rahul s/o Rajenda Hiranwar has taken away his brief from his office in last week of February 2020 itself. Therefore, he is unable to argue the matter.

When client took the file from Advocate, it is expected from such Advocate to obtain acknowledgement .....2/-

apl223.20 4 that file is taken from his office and to issue Notice under the Advocates Act, 1961 for withdrawal of his Vakalatnama. Nothing that sort is being done in the present case. 4.

If file is already taken from office of learned counsel, it was duty of the applicant to engage another counsel. As on today, nobody has filed Vakalatnama on his behalf.

In this view of the matter, the above shows that the applicant is not interested in prosecuting the matter. Hence, the criminal application stands dismissed for want of prosecution.
