O R D E R

(Dated 09/09/2017) Smt. Laxmibai Fulzele and Ku. Vaishali Sukhdeo Fulzele, legal heirs of respondent no.1 are present. Shri R.K. Bharne, Executive Engineer, Bembla Project, VIDC, Yavatmal is present. In view of settlement between the parties vide Exhibit - X, the appellant has withdrawn the appeal.

The claimants are entitled to withdraw the amount deposited in the Court along with interest accrued thereon. The appellant has agreed to deposit the balance amount of enhanced compensation in this Court within six months. The claimants are entitled to withdraw said amount after amount is deposited in the High Court.

The first appeal is disposed of in terms of compromise pursis.
