Heard Shri Quazi, learned counsel for the petitioner, Shri Kankale, learned AGP for respondent No. 1, Shri Potbhare, learned counsel for respondent Nos. 2 & 3 and Shri Dhore, learned counsel for respondent No. 5.

The challenge in the present writ petition is to the order dated 16.12.2013 passed by Respondent No. 4, returning the proposal for grant of approval to the appointment of the petitioner as Assistant Teacher. The learned counsel for the parties have brought to notice of this Court a communication dated 15.01.2015 issued by Respondent No. 4 calling upon the Members of the management to submit a fresh proposal duly signed by the Members whose names are stated in Schedule I of the Public Trust record.

Shri Potbhare and Shri Dhore, learned counsel for the respective respondents state that the

62wp1556.14 dispute in that regard has now been amicably worked out and a fresh proposal duly signed by the Authorized signatories would be submitted for its due consideration to Respondent No. 4 within a period of two weeks from today.

In view of the aforesaid, Respondent Nos. 2, 3 & 5 are directed to submit fresh proposal in relation to seeking approval to the petitioner's appointment within a period of two weeks from today. Respondent No. 4 shall thereafter within a period of six weeks take appropriate decision on said proposal. Respondent No. 4 would be free to hear the concerned parties, if necessary. For said purposes, the impugned order dated 16.12.2013 stands set aside.

Writ Petition is allowed in aforesaid terms and disposed of. There shall be no order as to costs. JUDGE JUDGE *GS.
