Shri Tushar Tathod, learned counsel for the applicants, Shri N.S. Rao, learned APP for respondent No. 1. The submission of learned counsel for the applicants is, as per documents available, M/s. R.K. Trading Company at Indore have duly got M.O.U. signed, as such the offence, if any, is not committed by the applicants. The learned APP submits that the defences cannot be accepted at this stage.

However, Shri Tathod, learned counsel submits that Respondent No. 1 is not likely to conduct the inquiry properly and will persecute the petitioners.

We do not find any substance in the apprehension of Shri Tathod, learned counsel. Respondent No. 1 has to look into all the facts independently and impartially. Hence, without observing anything on merits of the case and keeping all rival contentions open, we dispose of the present Criminal Application at this stage. No costs. JUDGE JUDGE *GS.
