Shri A.B. Nakshane, learned counsel, appears for non-applicant no.1 and states that he has instructions to waive notice of the appeal on behalf of the claimant. On the motion made by the learned counsel for the applicant, the proceedings are restored against nonapplicant no.1. Necessary corrections be carried out forthwith.

Though the prayer for condoning delay is opposed by the learned counsel for the non-applicant no.1, considering reasons mentioned in the application,
