Criminal Application (APPR) No.32 of 2017 This application is for suspension of substantive sentence and for release on bail. Heard learned counsel for the applicant and learned Additional Public Prosecutor.
It is submitted that applicant was on bail pending Trial and that after applicant was convicted by the Trial Court pending his appeal his sentence was .....2/-
suspended. It is thus prayed that application be allowed.
It is found that applicant is convicted by the Magistrate's Court for the offences punishable under Sections 354 and 506 (1) of the Indian Penal Code and is sentenced to suffer rigorous imprisonment for two years and to pay a fine of Rs.1,000/-, in default, to suffer rigorous imprisonment for one month for the offence punishable under Section 354 of the Indian Penal Code and is sentenced to suffer rigorous imprisonment for two years and to pay a fine of Rs.1,000/-, in default, to suffer rigorous imprisonment for one month for the offence punishable under Section 506(1) of the Indian Penal Code.
Appeal preferred is dismissed by learned Additional Sessions Judge, Chandrapur.
Considering short sentence imposed upon appellant and since applicant was on bail and as his sentence is admittedly suspended, pending appeal who is also stated to have made payment of fine amount, application is allowed, as per order below:
Applicant shall be released on bail on his executing P.R. Bond in the sum of Rs.15,000/- with one surety in the like amount.
While on bail, applicant shall mark his presence with Ramnagar Police Station, District Chandrapur once in three months on the first day of .....3/-
each such month.
The applicants shall submit proof of his residence with the investigating officer and shall update the same in the event of change in future.
