DATED : 21 st March, 2016 We find that in the initial judgment dated 27.6.2013 this court expected the State Government to pass appropriate orders on pending representation within four months. As that was not done, petitioner employee approached this court again by filing civil application in disposed of matter. This court on 17.4.2015 passed orders on that civil application and further period of four months was granted. The representation is dated 5.2.1998.

Advocate Vyawahare submits that pending decision of representation applicant was permitted to withdraw 50% of the amount deposited and the remaining 50% amount is still pending. He contends that that amount has been deducted from non-salary grant of respondent no. 5 employer and has been deposited here.

caw500-16.odt In this situation, we permit applicant petitioner to withdraw the amount in deposit with Registry of this court with interest accrued upon it. It is made clear that depending upon outcome of representation, State Government shall be required to reimburse the respondent no.5 management the amount appropriated from non-salary-grant if this court so directs.
