The application for impounding document namely power of attorney came to be rejected by the learned trial Court on the ground that, the suit was not filed through power of attorney, moreover, in the evidence box the son of the plaintiff is entering as a witness and not as power of attorney holder. It is further held that, the plaintiff herself has stated in writing in a reply Exh.61 i.e. reply to the application that, she is not going to enter as power of attorney in the evidence.

In the circumstances, the reasons stated in the paragraph 5 of the impugned order show that the application Exh.57 is misconceived.

In that view of the matter, no interference is narrated. Hence, the writ petition is dismissed. JUDGE C.L. Dhakate
