DATE : 23.6.2015 Heard Shri S.O. Ahmed, the learned advocate for the petitioner/plaintiff. The trial Court has rightly rejected the application filed by the petitioner for deleting the concerned issue. The learned trial Judge has recorded proper reasons and has rightly relied on the order passed by this Court in the earlier round of litigation in Civil Revision Application No.8/2010. I do not find any illegality in the impugned order. It cannot be said that the learned trial Judge has failed to exercise the jurisdiction vested in him or has overstepped the jurisdiction. The petition is dismissed. No costs. JUDGE Tambaskar.
