DATE : September 09, 2015 Considering the valuation of the suit, the present appeal will have to be entertained by the District Court, Nagpur under provisions of Order-43 Rule-1(r) of the Civil Procedure Code. Shri A. A. Naik, learned counsel for the appellant seeks permission to withdraw the appeal with liberty to file the same before the District Court.
Permission to withdraw the appeal is granted with aforesaid liberty. The misc. appeal be filed before the District Court within period of six weeks from today. Shri C. J. Dhumne, learned counsel for respondent No.1 undertakes to appear on behalf of respondent No.1 before the District Court on 26/10/2015. Shri C.A. Joshi, learned counsel for respondent No.3 states that he would inform the respondent No.3 about the aforesaid order. The ad interim stay granted on 12/06/2014 shall continue to operate until the same is modified by the District Court. Order accordingly. JUDGE Asmita
