Prayer is to permit the appellant to deposit 75% of the amount, as awarded by the Reference Court, in terms of order dated 30th September, 2013. Reasons for failure to comply with earlier order have been mentioned in para 2 of the application. Though copy of the application is served on the counsel for respondent no.1, there is no appearance to oppose the prayers made therein. Hence, the appellant is permitted to deposit 75% amount in this court in terms of order dated 30th September, 2013, within a period of one week from today. If the aforesaid order is complied, then during the pendency of the first appeal, the effect and operation of the order passed by the Reference Court shall remain stayed.
