This is an application for early hearing by fixed date moved by petitioner.

Shri Kedar, learned Counsel for petitioner, has submitted that respondent no.1 retired in December 2014 and as per rules, gratuity amount is calculated, which comes to Rs.3,08,969/- approximately. However, if petition is allowed, respondent no.1 shall not be entitled for the said amount. It is, therefore, submitted that either petition be heard or aforesaid amount may be permitted to be deposited in the Court.

Learned Counsel for both sides state that petition be heard by giving a fixed date.

In the circumstances, civil application is allowed. The petition be shown in the caption of final hearing on 9/8/2017.
