The learned counsel for the applicant - original complainant states that the application be disposed of as withdrawn with liberty to prefer appeal.

Mr. S.V. Sirpurkar, who appears on behalf of the accused states that the liberty may be subject to issue such as limitation.

Issue of limitation, and the condonation of delay, if any, are all aspects which shall fall for determination for the appropriate bench. It would not be necessary for me to make any observation.
