Rule. Rule made returnable forthwith. Heard finally with the consent of the learned counsel for the parties. 2.

In this writ petition, the petitioners inter alia are aggrieved by inaction on the part of the respondents in not taking a decision for transfer of the school from Aradhananagar to Shantinagar in Nagpur City.

Learned counsel for the petitioners submitted that the petitioner-society had submitted a proposal through Education Officer, Nagpur to the Deputy Director of Education, Nagpur

904wp1022.25.odt Division, Nagpur, who in turn, has forwarded the same to the State Government, however, the State Government has failed to take a decision on the aforesaid proposal. It is further submitted that the writ petition be disposed with the direction to the competent authority of the State Government to take a decision expeditiously in a time bound manner. 4.

On the other hand, learned Assistant Government Pleader, on instructions, submits that suitable action on the proposal of the petitioners submitted by the Education Officer, shall be taken in accordance with law.

In view of aforesaid submission and facts of the case, the writ petition is disposed of with a direction to the State Government to take a decision on the proposal of the petitioners submitted by the Education Officer, Nagpur in respect of shifting of the School run by the petitioners-society, expeditiously preferably within a period of eight weeks from today. 6.

It is made clear that this petition is not heard on merits of the matter.
