It is not in dispute that the charge-sheet in respect of the offences in question, namely under Sections 363, 366-A and 376 of Indian Penal Code and Sections 4 and 12 of the Protection of Children from Sexual Offences Act, 2012, has already been filed after completion of investigation.
The applicant is in jail since 25th November, 2014. Learned counsel for the applicant submits that the applicant resides at Undari, Tq. Chikhali, Distt. Buldana, while the prosecutrix is a resident of village Vadali, Tq. Mehekar, Distt. Buldana.
In view of completion of investigation and filing of
the charge-sheet and in view that both the applicant and prosecutrix are residents of two different places, I am inclined to make the following order:-
O R D E R
[a] Criminal Application No. 142 of 2015 is allowed.
[b] Applicant is ordered to be released on bail upon furnishing a Personal Bond in a sum of Rs. 10,000/- [rupees ten thousand only] with one surety in the like amount.
[c] The applicant shall not enter the place of residence of prosecutrix, nor shall follow the victim anywhere. In default, the order of bail would be recalled.
[c] Applicant shall report to Amdapur Police Station, Distt. Buldana, on last Sunday of every month between 11.00 a.m., and 4.00 p.m., Judge |hedau|
