The applicant is seeking pre-arrest bail apprehending arrest in crime registered against him for the offence punishable under Sections 406, 420 read with 34 of the Indian Penal Code. The allegations against the applicant are that he being a Director of an Investment Company has duped investors.

This Court by the order dated 31st December, 2015 granted ad-interim protection to the applicant. Subsequently, the non-applicant complained that the applicant is not co-operating in the investigation. This allegation was denied by the applicant. An order was passed on 12th February, 2016 directing the applicant to report daily at the police

2 aba714.15 station and co-operate with the Investigating Officer. The learned A.P.P. has submitted that the applicant has co-operated with the investigation. It is submitted by the learned A.P.P. that the applicant has stated that he is not aware about the addresses of co-accused who are absconding.

Considering the facts on the record and the nature of allegations, the following order is passed:

(i) The interim protection granted by this Court on 31st December, 2015 is confirmed.

(ii) In the event of arrest of applicant in relation to Crime No.212/2015 registered by the non-applicant, the applicant shall be released on bail on furnishing P.R. bond in the sum of Rs.20,000/- (Rs. Twenty Thousand Only) with one solvent surety in the like amount.

(iii) It is further directed that the applicant shall attend the police station on alternate day between 11 a.m. to 5.00 p.m. and co-operate with the investigation. This condition shall continue to operate till the addresses of co-accused are found and they are arrested or brought to the process of law.

(iv) The applicant shall surrender his passport immediately to the

In case the applicant is not having the passport, he shall submit an affidavit to that effect.

(v) The application is allowed in the above terms. No orders as to costs.
