In short, it is the case of the petitioner that two houses bearing Nos.275 and 297 were acquired by the respondent authorities for Gosekhurd irrigation project. House No.275 was in the name of the wife of petitioner whereas, house No.297 was in the name of the petitioner. It is the case of the petitioner that the amount in lieu of employment was paid to his wife but not to him.

Learned Assistant Government Pleader has pointed out that even if both houses were acquired, which were in the name of husband and wife i.e. the petitioner and his wife, however, one member is entitled for employment as per the Government Resolution and accordingly, the amount of compensation in lieu of employment, was granted and paid to the wife of the petitioner.

We find substance in the submission of the learned Assistant Government Pleader and as such, we are of the opinion that such benefit was rightly denied to the petitioner.

Accordingly, the petition stands dismissed. No costs.
