The applicant is a minor represented through her natural guardian/father. He wants to challenge the judgment of the Reference Court. However, there is a delay of 235 days. It is opposed on behalf of the respondents. The reasons are convincing. The delay is condoned.
Civil Application (F) No.3845/2018 Though the appellant is desirous of preferring an appeal he has not paid the Court fee of 58,830/-. It was on account of ┞Ӏ financial incapacity. The appellant is ready to pay the Court fee from the decretal amount if it is deposited by the acquiring body. There is no appeal by the respondents. Hence, there is no question of granting stay. Under these circumstances, the appellant may try to raise the finance for payment of Court fee and the learned AGP is requested to ascertain from the respondents whether they have complied with the order of the Reference Court.
Stand over in the second week of February, 2021.
