HAQ, J.

DATED : 09-03-2016 Heard Shri Y.B. Mandpe, Advocate holding for Shri H.N. Potbhare, Advocate for the applicant and Shri R.S. Nayak, Additional Public Prosecutor for the nonapplicant. 2.

The applicant is seeking pre-arrest bail in crime registered against him for offences punishable under Sections 385 and 387 of the Indian Penal Code. The case of the prosecution is that the applicant who is a Journalist, stopped the vehicle of first informant, asked him to show the royalty of the sand, which he was carrying and then demanded Rs.10,000/- from the first informant contending that royalty shown by the first informant was bogus and when first informant refused to pay the amount, the applicant threatened to beat him. 3.

Considering the nature of allegations and the fact that the non-applicant has not been able to show that the custody of the applicant is required for further

2 aba110.16 investigation, in my view, the interim order granted on 25-02-2016 is required to be confirmed.

4.

Hence, the following order :

i) In the event of arrest in Crime No.126/2016 registered by the non-applicant, the applicant shall be released on bail, on furnishing P.R. Bond in the sum of Rs.10,000/- and one solvent surety in the like amount.

ii) The application is allowed in the above terms. JUDGE pma
