DATED : 11-03-2020 The applicant is seeking enlargement on bail in connection with Crime 782/2019 registered with Arvi Police Station for offence punishable under Section 420 read with Section 34 of the Indian Penal Code. 2.

The allegation against the present applicant is that with the active assistance of the co-accused, he duped the complainant and several others by promising to deliver Honda two wheeler vehicle at a discounted price.

The submission is that since seven co-accused are released on bail, the applicant is entitled to similar order on the principle of parity.

The submission is considered only for rejection. 5.

The co-accused were released on bail after the

2 ba172.19 filing of the charge-sheet. However, since the present applicant was absconding, the charge-sheet was filed under Section 299 of the Criminal Procedure Code. The applicant was arrested on 24-1-2020 and qua him the investigation ongoing.

In this view of the matter, I was not inclined to grant bail.

At this stage, the learned Counsel for the applicant, on instructions, seeks leave to withdraw the application with liberty to approach the Court for bail after the filing of charge-sheet and/or completion of investigation against the applicant.

The application is disposed of as withdrawn with liberty.
