Criminal Application (APPA) No.146 of 2017 Heard.
This application is filed for suspension of substantive sentence imposed upon appellant and for grant of bail contending that applicant was on bail pending trial and on his conviction his sentence is .....2/-
suspended by the Sessions Court, Nagpur vide its order dated 8.2.2017 for a period of one month.
It is found that applicant is convicted for the offence punishable under Section 354 of the Indian Penal Code and Section 8 of the Protection of Children of Sexual Offences Act, 2012 and is sentenced to suffer rigorous imprisonment for one year and to pay a fine of Rs.500/-, in default, to suffer simple imprisonment for two months for the offence punishable under Section 354 of the Indian Penal Code and rigorous imprisonment for three years and to pay a fine of Rs.500, in default, to suffer simple imprisonment for one month for the offence punishable under Section 8 of the Protection of Children of Sexual Offences Act, 2012. Considering fact that applicant was on bail pending Trial and since his sentence is already suspended for a period of one month and applicant has paid amount of fine, application is allowed as per the order below:
Applicant shall be released on bail on his executing P.R. Bond in the sum of Rs.25,000/- with one surety in the like amount.
While on bail, applicant shall mark his presence with Mauda Police Station, Nagpur on the first day of each alternate month, pending appeal.
The applicant shall submit proof of his .....3/-
residence with the investigating officer and shall update the same in the event of change in future.
The criminal application is disposed of accordingly.
