Shri Firdos Mirza, learned Counsel for the applicant states that the applicant has not been able to furnish solvent sureties and prays for release of the applicant on cash surety. The said request is opposed by Shri N.R. Chutke, learned A.P.P. representing the State.
02] By order, dated 23/02/2021, this Court had ordered release of the applicant on temporary bail for a period of four weeks on furnishing Bail Bond of Rs.50,000/- with two solvent sureties in the like amount.
03] Learned Counsel for the applicant states that the trial Court has refused to accept the sureties furnished by the applicant on the ground that they are from Telengana State. It is submitted that the applicant is still undergoing treatment and request is made to release the applicant on cash surety and also to extend the time to furnish the solvent sureties.
appa.415.21 2/2 04] Copy of the order, dated 01/03/2021 passed in Criminal Application No.744/2021 filed in Criminal Appeal No.52/2021 has been placed to contend that in similar circumstances, the Division Bench at Principal Seat has permitted the applicant to furnish cash surety.
05] Considering the fact that the applicant has been ordered to be released on temporary bail in view of his medical condition and that he has not been able to procure solvent sureties, the applicant is permitted to furnish cash surety in the sum of Rs.50,000/-. Time to furnish solvent sureties in terms of order, dated 23/02/2021 is extended by two weeks.
06] Accordingly, the applicant is ordered to be released on furnishing cash surety in the sum of Rs.50,000/-. All other conditions stated in the order, dated 23/02/2021 shall continue without any modification.
07] Upon cash surety being furnished, learned Sessions Court at Gadchiroli shall send release order to Taloja Central Jail, Mumbai by email or any other electronic mode.
08] The application is disposed of accordingly.
