Perused this application for pre-arrest bail under Section 438 of the Criminal Procedure Code. During the pendency of this application, the matter was referred to the Mediation. Accordingly, terms of settlement have been filed. The parties have settled the dispute, but the applicants are directed to pay the amount in time bound manner. Since then the applicants are paying the amount in time. 2.

The applicants are allowed to file the application for quashing the First Information Report. At present we can consider the fact of settlement of the dispute. Therefore, the interim order is hereby confirmed and the application is disposed of.

The complainant/party No.2 to the mediation is allowed to withdraw the amount of Rs.5,00,000/- deposited in this Court as per order dated 17.11.2021.

If the applicants commit breach of the terms of the settlement then the respondent is at liberty to move this Court for cancellation of pre-arrest bail.
