It would not be necessary to issue notice to the respondent no.1 as no notice was served on the respondent no.1 before the writ petition was dismissed for want of prosecution. For the reasons stated in the application, the prayer made in the application is granted and the delay in filing the restoration application is condoned.

Heard. Perused the contents of the application. For the reasons stated in the application, the writ petition is restored to file subject to payment of costs of Rupees Five Hundred in the High Court Bar Library, Nagpur within a period of one week.
