Heard learned counsel for the applicants and learned counsel for respondent No.2 and also learned APP for the respondent No.1.
2] Applicants and respondent No.2 agreed that there is amicable settlement between them, wherein the respondent No.2 has agreed to withdraw all her allegations against the applicants and will have no objection if the First Information Report, registered against the applicants on the basis of her complaint, is quash and set aside. 3] We are satisfied that the amicable settlement, so arrived at between the parties, is voluntary. The offences registered against the applicants revealed private dispute between the parties. Therefore, in our view, this is a fit case for quashing the First Information Report in question.
14.apl.379.2021.odt 4] The application is allowed in terms of prayer clause (i) which reads thus:
"(i) Quash and set aside the First Information Report vide crime no.0174/2020 dated 24/11/2020 registered by Non-applicant No.1 Sonegaon Police Station, Nagpur for offences punishable under sections 498(A), 323, 294, 506(2) and 34 of IPC against the Applicants, annexed herewith as 'Annexure 1'." This is subject to the condition that applicants shall, jointly and severally, deposit amount of Rs.10,000/- in the account of District Prison, Yavatmal for the purpose of development of library for jail inmates and respondent No. 2 shall deposit an amount of Rs.5000/- in the account of Central Prison, Nagpur for the purpose of development of library for jail inmates, within two weeks from the date of the order, failing which this order shall stands canceled automatically and this application shall be restored to the file and be listed for necessary directions. 5] The Criminal application stands disposed of accordingly.
