By this Writ Petition, the petitioner challenges the order of the Divisional Commissioner rejecting the application of the petitioner for grant of parole leave.
We do not find any fault with the impugned order so as to interfere with the same in exercise of the writ jurisdiction. The brother of the petitioner does not suffer from any serious ailment. The brother of the petitioner appears to be suffering from kidney stone ailment and only a Laser operation is to be performed on him. Moreover, there are other members in the family of the petitioner who could look after the brother of the petitioner. The brother of the petitioner was not admitted in any hospital because of his ailment. If that be so, the Divisional Commissioner rightly held that the reason put forth by the petitioner for seeking parole leave was not enough for granting the same.
In the result, we dismiss the Writ Petition with no order as to costs. The petitioner is, however, free to apply for leave in future for any other reason, if an occasion arises. Order accordingly.
