DATE : 22.4.2016 Heard Shri A.B. Moon, advocate for the applicant and Shri S.S. Doifode, A.P.P. for the non-applicant.

The applicant apprehends arrest in crime registered against him for the offence punishable under Sections 420, 468 and 34 of the Indian Penal Code on the accusations that the complainant and some other persons are duped by the applicant and co-accused. According to the prosecution, the Ashok Agro Foods Private Limited advertised on local T.V. Channels, inviting deposit of Rs.25,000/- to get employment on salary of Rs.8,000/- per month and accordingly some persons visited the office of the company and deposited the amount. According to the prosecution, the complainant and the other persons who deposited the amount were paid Rs.8,000/- for the first month, however, subsequently they are neither given employment nor are paid any amount.

The case of the applicant is that he himself was working as an employee with the company.

The application is opposed on various grounds and one of

2 aba111.16 the ground is that the main accused is absconding. Considering the nature of accusations against the applicant, the facts on the record and as the non-applicant has not been able to show that the custody of the applicant is required for further investigation, in my view, the interim order granted on 25th February, 2016 is required to be confirmed.

Hence, the following order:

(i) In the event of arrest in Crime No.14/2016 registered by the non-applicant, the applicant be released on bail on furnishing P.R. bond for Rs.10,000/- (Rs. Ten Thousand Only) and one solvent surety in the like amount.

(ii) The applicant shall attend the police Station Kingaon Raja, Distt. Buldhana every Wednesday till 15th July, 2016. (iii) The application is allowed in the above terms. JUDGE Tambaskar.
