06th March, 2017 The respondent no.2 seeks permission to withdraw the amount of compensation deposited by the appellant.

The application is opposed by the learned counsel for the appellant on the ground that the Claims Tribunal has awarded higher compensation by taking an incorrect multiplier.

Perused the impugned judgment.

The respondent no.2 is permitted to withdraw an amount of

Rs.4,00,000-00 [rupees four lakhs only] on filing an undertaking that in case the appeal is allowed, said amount shall be repaid with interest at such rate the Court may direct.

Civil Application is disposed of.
