This appeal is filed on behalf of the State of Maharashtra seeking leave to file appeal against nonapplicant/Gajanan Sampatrao Aandhale who was acquitted by judgment and order dated 4.5.2019 passed by learned Additional Sessions Judge, Washim in Special ACB Case No.1/2010 filed for offences punishable under Sections 7 and 13(1)(d) read with Section 13(2) of the Prevention of Corruption Act, 1988.

Today, when this application along with the appeal was taken up for admission, learned counsel Shri V.R.Deshpande for non-applicant submits that during the .....2/-

appa170.20 9 pendency of this application, non-applicant/Gajanan Sampatrao Aandhale passed away on 8.5.2021. He tenders a copy of death certificate issued by the Chief Officer, Nagar Panchayat at Malegaon dated 12.5.2021. The said certificate is taken on record and marked as Exhibit-X for the purposes of identification. Perusal of the said document issued by the appropriate authority shows that non-applicant/Gajanan Sampatrao Aandhale passed away on 8.5.2021 and to that effect his death was registered on 10.5.2021 and the certificate was issued on 12.5.2021.

In view of the death of non-applicant/Gajanan Sampatrao Aandhale, nothing survives in this appeal. 5.

The criminal application and the appeal stand disposed of as such.
