The applicant is seeking pre-arrest bail apprehending arrest in crime registered for offences punishable under Sections 65(a), 98(c) and 83 of the Maharashtra Prohibition Act.

According to the prosecution, Car carrying stock of liquor was intercepted and two persons namely Mukesh Badode and Sonu Bhoyar who were in the Car stated that the stock was being transported on the say of the applicant. According to prosecution, the registration card shows that the Car used for transporting stock of liquor is in the name of Tushar Rawal.

The applicant is student of Government

2 aba113.16 Polytechnic College. The applicant has stated that he is not involved in any crime earlier and this fact is not controverted by the non-applicant.

Considering the facts on the record, in my view, the interim order granted on 01-03-2016 is required to be confirmed.

Hence, the following order :

i) In the event of arrest in Crime No.6213/2015 registered by the non-applicant, the applicant be released on bail, on furnishing P.R. Bond for Rs.10,000/-.
