Heard learned counsel Shri R.N.Ghuge for the applicant/claimant.

This application is filed on behalf of the original claimant for condonation of delay in preferring an appeal since he was dissatisfied with determination of compensation. There is delay of 768 days.

On 24.6.2021, this Court (Coram : S.M.Modak, J.) issued Notices to non-applicants. In pursuance to said Notices, learned AGP Ms T.H.Udeshi appears for nonapplicant Nos.1 and 2/State and learned counsel Shri M.A.Kadu appears for non-applicant No.3. No reply is filed on behalf of any of non-applicants.

After hearing learned counsel for parties and after perusing uncontroverted statement of facts made on affidavit, I find that the applicant has made out a case for condonation of delay.

Hence, the application is allowed and disposed of. The delay stands condoned. Office is directed to register the appeal.
