The applicant has filed this application to transfer the matter which is pending before the Family Court, Nagpur by the non-applicant for divorce to Akola.

Learned counsel for the applicant has stated that the applicant is staying at Akola with her mother and her 3 years old son. She is not doing anything, she is dependent on her mother, who is working. She has lost her father recently and there is nobody to escort her to Nagpur, hence, prayed to transfer the matter which is pending before the Family Court, Nagpur to Family Court, Akola.

Though, the non-applicant is served, is not present since last two to three dates, the learned counsel appearing for the non-applicant is also not present.

Heard learned counsel for the applicant.

The applicant is staying with her mother and the applicant has lost her father recently. It will be difficult for her to carry her three year old child to attend the matter at Nagpur.

Hence, the Miscellaneous Civil Application is allowed. The Hindu Marriage Petition No.A-1613/2023, pending before the Family Court, Nagpur, is transferred to the file of Family Court, Akola.
