Though the applicant made attempts to serve the non-applicant on the address last known as well as at his ancestral house at Titur, Tahsil Kuhi, District Nagpur, are in vague. In view of these facts, learned counsel submits that the applicant be permitted to serve the non-applicant taking recourse to the provisions under Sections 64 and 65 of the Criminal Procedure Code.

Learned counsel submits that as the controversy is in respect of maintenance to the applicant, who is in her advanced age and non-applicant who is retired employee .....2/-

appr105.14 of Railway Department, the application be allowed.

In view of the statement made as well as on the grounds raised in the application, the application is allowed and disposed of subject to applicant's taking necessary steps namely depositing amount for publication in the local newspaper having wide circulation.
