Heard Shri S.A. Chaudhari, advocate for the applicant and Shri R.S.Nayak, A.P.P. for the non-applicant. The applicant is arrested on 30th November, 2015 in crime registered against him for the offence punishable under Section 354, 354(A)(1), 506, 354(D) and 34 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act, 2012 on the accusations that the applicant misbehaved with the victim and gave threats to the victim.

The application is being opposed on the ground that the applicant is creating nuisance in the locality. The charge-sheet is filed. The co-accused Ajay @ Vaibhav Khobragade is granted bail. Considering the facts on record and as the non-applicant has not been able to show that the custody of the applicant is required for further investigation, in my view, the applicant is entitled to be released on bail.

2 ba133.16 Hence, the following order :

i) The applicant having been arrested in Crime No. 256 of 2015, registered by the nonapplicant, he be released on bail on furnishing P.R. Bond for Rs.Twenty Thousand and one solvent surety in the like amount.

ii) The applicant should not reside in Ashtabhuja Mandir Ward, Chandrapur till the trial is completed.

iii) The applicant shall inform the Investigating Officer the address on which he would be residing and the cellphone number before he is released on bail.
