DATED : 20-06-2023 The petitioner claims to be the son of one of the trusties of the public Trust.

The grievance of the petitioner is that the suo motu enquiry initiated under Section 41B of the Maharashtra Public Trusts Act is proceeding extremely tardily.

However, today Mr. R.M. Pande fairly states that the enquiry is nearly complete.

We are not inclined to interfere in the matter and set a deadline.

We must take judicial notice that there could be several suo motu enquiries which may have been initiated prior to the enquiry which is the subject matter. No details are given in the petition from which we could have ascertained how many suo motu enquiries are pending and how many of them are initiated prior to 2017. That apart, the locus of the petitioner who claims to be the son of the trustee, is challenged by the respondents.

While we hope and expect that the authority shall expeditiously proceed in the matter, subject to the seniority of the suo motu enquiry and the work load, we are disposing of the petition without setting any definite timeline.
