At the outset, Shri R.R. Vyas, learned counsel for the applicant, on instruction from the applicant submits that to withdraw the application since the applicant intend to file application for discharge before the Court below. The application is disposed of as withdrawn with a liberty to the applicant to file an application for discharge before the Court below.

It is made it clear that the case of the applicant was not heard on its own merit. In case, the application for discharge is filed by the applicant, the learned Judge before whom such an application will be filed shall decide the said application in accordance with law.
